Probate
Probate is the process that transfers legal title of real and personal property from the estate of the person who has died (the "decedent") to his or her proper beneficiaries. Probate includes proving the existence of a valid Will, or determining who the legal heirs are if there is no Will.
The probate process also provides for the collection of any taxes due by reason of the decedent's death or the transfer of his or her property, for payment of outstanding debts and claims owed by the decedent, and distribution of the decedent’s remaining property according to the Will or by intestate succession to the decedent’s heirs if there is no Will.
